1. PRIVACY POLICY of the shopsun.eu website

This Privacy Policy outlines the methods of protecting the personal data of Users (i.e., individuals using the online Store’s website, including those placing Orders as defined below), who access the store’s website available at www.e-markizy.pl, hereinafter referred to as the “Store” or “Service.”

Non-acceptance of this Privacy Policy is equivalent to the inability to use the Store’s website, including placing Orders.

The administrator of Users’ personal data is “Centrum Handlowe Adams Sp.j Łotoccy,” located in Żary, ul. Górnośląska 17, 68-200 Żary, registered in the National Court Register under the number KRS:0000489695, NIP: 9282078809, REGON: 081178657. The owner of the Store conducts sales of Goods through it based on the terms outlined in the Regulations, without the simultaneous presence of the parties, using telecommunications networks, hereinafter referred to as the “Seller.”

Data Security and Protection

The Seller declares that it processes Users’ personal data in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter GDPR). In particular, the Seller – considering the nature, scope, context, and purposes of the personal data processing and the risk of varying likelihood and severity for the rights or freedoms of natural persons – implements appropriate technical and organizational measures to ensure that the processing is performed in accordance with GDPR and to be able to demonstrate this compliance.

Scope of Data Collection

The Seller collects data from Users, particularly those placing Orders (“Customers”), in the manner specified in the Regulations.

To create an account in the Store, the User must provide the data necessary to use the Account service, i.e., first name, last name, email address, and set a password for the account. The email address provided by the User also serves as the login to the Store.

To place an Order, the Customer must provide data that ensures the possibility of fulfilling the order and enables contact with the Customer, i.e., first and last name, email address, delivery address, and phone number.

Purpose of Data Collection

The personal data of the User is processed for the following purposes:

  1.  To conclude and execute an electronic service agreement – when the User uses such services.
  2.  To conclude and execute a sales agreement, including for the purpose of handling potential complaints.
  3.  In the event of purchasing Goods, personal data is also collected in accounting documentation and will therefore be processed for the Seller’s accounting purposes.
  4.  To respond to inquiries submitted via the contact form.
  5.  If the User wishes to receive marketing content about the Seller, the User’s personal data is also processed for the purpose of sending such content.
  6.  To consider a request regarding personal data.
  7.  For statistical purposes for the internal needs of the Administrator, including sending customer satisfaction surveys. In this case, the basis for processing will be the legitimate interest of the Administrator in collecting information that allows for business development and service adaptation to the needs of Store Users.

Providing personal data is voluntary but is a condition for concluding an electronic service agreement as well as a sales agreement. The consequence of not providing personal data for these purposes is the inability to provide services by the Seller and the inability to conclude and execute a sales agreement.

Regarding the sending of marketing content at the User’s request, providing personal data is voluntary; however, failure to provide such data will result in the inability to send such content.

The User’s personal data will not be used for automated decision-making, including profiling.

Legal Basis for Personal Data Processing

The legal basis for processing Users’ personal data is:

  1.  The necessity of processing to conclude and execute an electronic service agreement – when the User uses such services.
  2.  The necessity of processing to conclude and execute a sales agreement, including for handling potential complaints.
  3.  In the event of purchasing Goods – the necessity to fulfill a legal obligation incumbent on the Seller, which involves maintaining accounting records. This obligation arises from generally applicable laws, particularly the Tax Ordinance Act of August 29, 1997, the Accounting Act of September 29, 1994, and the Goods and Services Tax Act of March 11, 2004.
  4.  The necessity of data processing to achieve purposes resulting from the legitimate interests pursued by the Seller, including handling correspondence and responding to inquiries.
  5.  In the event that the User wishes to receive marketing content about the Seller – the necessity of data processing to achieve purposes resulting from the legitimate interests pursued by the Seller, i.e., to carry out marketing activities related to the Seller.
  6.  The fulfillment of a legal obligation to consider a request concerning data protection.

Periods of Personal Data Storage

  1.  Personal data processed for the purpose of concluding and executing an electronic service agreement are stored for the duration of the User’s use of these services in accordance with the Regulations. After ceasing to use the services, the User’s personal data, including first name, last name, and email address, will be stored until the expiration of the civil claims limitation period.
  2.  Personal data processed for the purpose of concluding and executing a sales agreement, including handling potential complaints and maintaining the Seller’s accounting records, are stored until the expiration of the periods specified by applicable law, i.e., until the expiration of the tax liability limitation period, which may be extended in relevant cases by the civil claims limitation period.
  3.  Personal data processed to respond to inquiries submitted via the contact form are stored for the period necessary to address the inquiry.
  4.  Personal data processed for sending marketing content – from the moment of receiving the request to cease sending marketing content, the data is stored only for the purpose of defending against potential claims related to such sending, for the period specified by the law concerning the limitation of claims.
  5.  Personal data processed for the purpose of considering a request regarding personal data – are stored until the expiration of the limitation period for claims related to the exercise of rights under data protection regulations.

User Rights

The User has the right to decide to what extent their personal data will be used. In particular, the User may withdraw consent to receive marketing content about the Seller at any time. Withdrawal of this consent does not affect the legality of the marketing content sent based on the consent before its withdrawal. Consent can be withdrawn by sending a request to sklep@e-markizy.pl.

Additionally, the User has the right to:

  1.  Request access to their personal data, rectification, deletion, or restriction of processing, as well as the right to data portability.
  2.  Object at any time to the processing of their personal data when it is processed to fulfill the Seller’s legitimate interests (including situations where the User wishes to receive marketing content about the Seller).
  3.  Withdraw consent for personal data processing at any time, if the processing is based on consent. Withdrawal of consent does not affect the legality of processing carried out based on that consent before its withdrawal.
  4.  Lodge a complaint with the President of the Personal Data Protection Office, located in Warsaw at ul. Stawki 2, 00-193 Warsaw.

The User can make any changes or other requests regarding their personal data by submitting a relevant application to the contact details provided in the “Contact Us” section of this Privacy Policy.

Cookies Mechanism

The Store uses small files called cookies. These files are stored by the server on the computer of a person visiting the Store’s website. A cookie file usually contains the name of the domain it comes from, its “expiration period,” and an individual, randomly selected number identifying this file.

The cookies mechanism is entirely safe for computers; through this mechanism, viruses cannot enter Users’ computers. Nevertheless, Users can limit or disable cookies access to their computers. If this option is chosen, navigation on the Store’s website will generally be possible, but it may limit the ability to use certain functions.

The Administrator may process data contained in cookies during the use of the Store’s website for the purpose of:

  1.  Identifying the User as logged in to the Store and informing them that they are logged in;
  2.  Remembering Goods added to the cart to place an Order;
  3.  Remembering data from completed forms used for placing Orders or logging into the Store;
  4.  Customizing the content of the Store’s website to the individual preferences and actual needs of the User (e.g., regarding colors, font size, page layout);
  5.  Delivering personalized content and advertisements, offering social media features, and analyzing website traffic;
  6.  Conducting anonymous statistics that present how the Store’s website is used.

Available web browsers generally allow cookies to be stored on the User’s end device by default.

The User can change the cookie settings at any time. These settings can be changed, in particular, to block the automatic handling of cookies in the web browser settings or to inform about their every placement on the User’s device. If the settings regarding cookies are not changed, it means that they will be placed on the User’s end device, and thus the Administrator will be able to store information on the User’s end device and access this information.

IP Address

The Seller reserves the right to collect the IP addresses of visitors to the Store’s website. These addresses can be helpful in diagnosing technical problems with the server, creating statistical analyses (e.g., determining which regions generate the most visits), and they can also be useful in administering and improving the Store.

Your personal data on our website may be processed by our technological and advertising partners, including but not limited to:

    The Service uses Google Analytics, a web statistics and analytics tool provided by Google, which offers insights into the Service’s data traffic.     In addition to Google Analytics, DoubleClick advertising features are active on this website. Through a Google cookie, additional data beyond the standard implementation of Google Analytics is collected. For this purpose, our service uses third-party cookies in addition to Google Analytics cookies. The purpose of DoubleClick is to display relevant advertisements to you, both ours and those of third parties. Your browser is assigned an identifier (ID), which serves as a pseudonym, allowing us to check which ads your browser has displayed and which ads the user clicked on.   4. Facebook Business Tools

    Regarding the use of Facebook Business Tools, together with Facebook, we act as joint controllers under Article 26(1) GDPR, based on agreements between the joint controllers: Facebook Controller Addendum to define the respective responsibilities for compliance with the obligations arising from the GDPR. According to these agreements, we are responsible for providing you with the following information:

  1.  The use of business tools is the realization of the legitimate interest of the Administrator and our trusted partners (Article 6(1)(f) GDPR), involving the conduct of marketing activities (behavioral advertising) and measuring the effectiveness of advertisements.

  1. Facebook Pixel

    Facebook Pixel is an analytical tool available through the Facebook service, which helps measure the effectiveness of advertisements based on the analysis of actions taken by Users in the Store. It is provided by Meta Platforms Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) and also enables personalized advertising on Facebook. This tool collects information about the use of the Store, which is then transmitted to Facebook’s servers. Note that Facebook may combine this information with other data it has acquired through your use of Facebook and then use it for its own purposes (including marketing). You can manage your privacy settings from your Facebook account.

    Be aware that other entities (including Meta Platforms Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, hereinafter Facebook, and Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, hereinafter Google) may also use cookies and similar technologies to collect or receive information from the Store or Application and other places on the Internet and use it to provide measurement and targeted advertising services. By managing your cookie settings, you can decide whether you consent to the collection and use of information for targeting advertisements.

Access to Third-Party Data

The personal data collected by the Seller is directly accessible only to authorized employees or subcontractors of the Seller and entities providing services to the Seller (such as accounting, IT, and technical support services, as well as document archiving and destruction services), who need access to the data to perform their duties.

If the User selects the option to register/login via an external service (e.g., Facebook), the User only shares information about their use of the Seller’s Store with the external service.

Personal data of Customers is also accessible to entities delivering the ordered Goods – to the extent necessary to perform the delivery, and to entities through which Customers make payments for Goods – to the extent that the Customer provides them with this data.

User personal data may be shared with entities authorized to receive it under applicable law, particularly relevant judicial authorities.

Disclaimer

This Privacy Policy does not cover any information regarding services or goods provided by entities other than the Seller, which may be posted on the Store’s pages commercially, as a guest, reciprocally, or not intended to achieve a commercial effect.

The Seller is not responsible for the actions or omissions of Customers, as a result of which the Seller processes the personal data provided by them in a manner specified in this Privacy Policy.
